Overview:

If you intentionally display information through any online medium, which is false in nature or harms the privacy or reputation of an individual, you will have committed the crime.

Example:

Posting wrong information while you already know is false that will result in damaged reputation of an individual

2. Spreading Or Creating Explicit Videos/Images Of A Person

  • Jail Time: Up To 5 years
  • Fine: Up to RS 5 Million
  • Extreme Cases: Fine and Jail Time

Overview

Intentionally displaying transmits of any of this kind of information with the help of images and displaying a real face will have committed the crime.

Example:

Photoshopping face of a real person on an unsuitable image like nude body.

3. Spreading Or Creating Explicit Videos/Images Of A Minor

5. Stalking Someone Through The Internet

Overview

Persisting on starting a relationship with an uninterested party via email, facebook, twitter or any other electronic means will have committed the crime.

Example:

Persistently calling or texting someone over a digital medium while the party shows no interest.

6. Hacking Phone/Email Accounts For Purpose Of Stalking

  • Jail Time: Up To 3 years
  • Fine: Up to RS 1 Million
  • Extreme Cases: Fine and Jail Time

Overview:

Gaining unauthorized access to an email and monitoring their private messaging will have committed the crime.

Example:

Hacking into someone’s email or social media account and then monitoring their emails or messages.

7. Creating Images/Videos To Disturb Person/Audience Without Permission

  • Jail Time: Up To 3 years
  • Fine: Up to RS 1 Million
  • Extreme Cases: Fine and Jail Time

Overview:

Making a video of a person and then uploading and sharing it publicly without the consent of the person will put you in charge of the crime.

Taking a photograph or recording an individual’s video and then posting it online publicly.

8. Online Stalking Of A Minor

  • Fine: Up to RS 10 Million

If you stalk a minor on the internet or through any other digital medium, the punishment will be doubled.

Example:

Harassing a minor over any digital medium or spying on them.

9. Spreading/Making Hate Speech

  • Jail Time: Up To 7 years

  • Extreme Cases: Fine and Jail Time

Overview:

Any public speech that contains racial hatred, inter-fait or sectarian related words will be punished.

Example:

Writing about ethnic/racial/sectarian on a blog/social media and sharing it publicly.

10. Intentional Spamming

  • Jail Time: Up To 3 Months
  • Fine: Up to RS 5 Million
  • Extreme Cases: Fine and Jail Time

Overview:

Persistently sending spam messages via SMS or email without the consent of the receiver will have you punished under this law.

Examples:

Sending SMS’s without having the person sign on your email /SMS subscription.

11. Online Spoofing/Fraud

  • Jail Time: Up To 3 years

Creating a website or a group page with the intention of fraud or defaming individuals or getting them to pay for false products/services will have you land in the crime.

Create a fake website, promote a service/product and ask people for money and then take their money away without providing the promised services.

12. Creating/Spreading/Using Malicious Code

Overview:

Writing, creating or making available any malicious code that could harm information systems in the form of corruption, alteration, destruction or theft will result in crime.

Examples:

Creating a virus or malware then providing it to interested parties or spreading it yourself in order to steal or delete information.

13. Gaining Unauthorized Access To Information Data or Systems/Networks

  • Jail Time: Up To 3 months
  • Fine: Up to RS 500,00
  • Extreme Cases: Fine and Jail Time

Overview:

Accessing information that is not authorized with a negative intent will land you in jail.

Example:

Gaining access or controlling a part of the system such as a tablet, phone or computer and then accessing data and using it for your own means.

14. Copying or transferring data without permission/unauthorized

  • Jail Time: Up To 6 months
  • Fine: Up to RS 100,000
  • Extreme Cases: Fine and Jail Time

Overview:

Copying data by gaining unauthorized data or transmitting that data to someplace will land you in the jail for six months.

Example:

Copying unauthorized data from a USB Flash drive or a phone or hacking a data rich website and then sending making it public.

15. Interfering With Information Data/Systems/Network

  • Jail Time: Up To 2 years
  • Fine: Up to RS 500,000
  • Extreme Cases: Fine and Jail Time

Overview:

If you dishonestly interfere with data with the intention of destroying it, you will be punished.

Examples:

Hacking a website or gaining access to someone’s social media account and deleting the information there.

16. Copying or Transferring Data Of Critical Infrastructure Without Permission

  • Jail Time: Up To 5 years
  • Fine: Up to RS 5 Million
  • Extreme Cases: Fine and Jail Time

Copying or deleting critical infrastructure data will be punished by imprisonment.

Examples:

Hacking into databases such as that of NADRA’s or any governmental institute and then interfering with the data.

17. Interfering With Critical Infrastructure Information Data/System

  • Jail Time: Up To 7 years
  • Fine: Up to RS 10 Million
  • Extreme Cases: Fine and Jail Time

Overview:

Copying or deleting critical infrastructure data will be punished by imprisonment.

Examples:

Hacking into databases such as that of NADRA’s or any governmental institute and then interfering with the data.

18. Showing/Speaking In Favor Of An Offense

  • Jail Time: Up To 7 years
  • Fine: Up to RS 10 Million

Overview:

Taking side of an offense and publicly glorifying it on social media is now a crime.

Example:

You side with groups like Taliban and publicly write in favor of them or you share news of an offense and support it publicly.

19. Recruiting or Funding Terrorism Through The Internet

  • Jail Time: Up To 7 years
  • Fine: Undisclosed fine
  • Extreme Cases: Fine and Jail Time

Overview:

Finding people on the internet to recruit them for terrorism or trying to fund terrorism through digital means is now punishable.

Examples:

You own or run a social media group that encourages the followers to donate to terrorism groups or you create and run a group that potentially aid these groups.

20. Forging Electronic Data

  • Jail Time: Up To 3 years
  • Fine: Up to RS 250,000
  • Extreme Cases: Fine and Jail Time

Overview:

Electronically forging documents or data to gain personal benefit will now be punishable.

Example:

You alter a critical document such as an agreement, contract or invoice to gain personal benefit through legal means.

21. Forging Critical Infrastructure Data

  • Jail Time: Up To 7 years
  • Fine: Up to RS 5 Million
  • Extreme Cases: Fine and Jail Time

Overview:

Electronically forging documents or data to gain personal benefit will now be punishable.

Example:

You alter a critical document such as an agreement, contract or invoice to put a company at a loss.

22. Committing Fraud Electronically

  • Jail Time: Up To 2 years
  • Fine: Up to RS 10 Million
  • Extreme Cases: Fine and Jail Time

Overview:

Deceiving someone through the act of committing fraud on the internet that will result in damage or harm to the involved people will result in jail and fine.

Example:

You create a situation where you enter in a relationship with a person with an intent to cause financial or personal damage.

23. Creating/Supplying/Obtaining Device For Use In An Offense

  • Jail Time: Up To 6 Months
  • Fine: Up to RS 50,000
  • Extreme Cases: Fine and Jail Time

Overview:

Producing, supplying, generation or offering to supply or import any such digital device that will help in committing a crime or offense will be punished.

Example:

If you create a software that is malicious in nature and supply it to someone to help in a cyber attack, or you write a code that will help steal data for someone else, you are punishable.

24. Using Identity Information Without Authorization

  • Jail Time: Up To 3 years
  • Fine: Up to RS 5 Million
  • Extreme Cases: Fine and Jail Time

Overview:

Obtaining, selling, transmitting or possessing any other person’s personal identity without authorization is punishable.

Example:

Using someone else’s email address or social media account to pretend someone who you are not.

25. Issuing Sim Cards Or Other Communication Devices Without Authorization

  • Jail Time: Up To 3 years
  • Fine: Up to RS 500,000
  • Extreme Cases: Fine and Jail Time

Overview:

Selling or providing a SIM card without proper means or verification through PTA is now punishable.

Example:

You sell a SIM card that is not verified or provide a SIM card to someone temporarily.

26. Intercepting Without Authorization

  • Jail Time: Up To 2 years
  • Fine: Up to RS 500,000
  • Extreme Cases: Fine and Jail Time

Overview:

Intercepting with an intent to cause damage will now be punishable.

Example:

Sending in transmissions that are not intended to be public from within a digital medium.
